ACCOMMODATION SERVICE AGREEMENT

This agreement is entered into between the natural and/or legal person hereinafter referred to as the “Guest” and Elbis Hotel, operated by Elbis Turizm Sağlık Gıda ve İnşaat Ltd. Şti., located at Narlı Mah. Mıhlı Asfaltaltı Sok. No:82, Altınoluk, Edremit, Balıkesir, Türkiye, hereinafter referred to as the “Hotel.” The Guest and the Hotel shall hereinafter be referred to collectively as the “Parties.”

The Parties acknowledge that this agreement constitutes an official offer, includes all terms governing the provision of paid accommodation services, and that all provisions set out below are binding upon the Parties. By making a reservation through www.elbis.com.tr, the Guest accepts that this agreement applies and may not be unilaterally amended by the Guest.

1. SUBJECT OF THE AGREEMENT

1.1 Under this agreement, the Hotel is obliged to provide accommodation services at the request of the Guest (hereinafter referred to as the “Service”).

1.2 By making a reservation for accommodation and/or services offered by the Hotel, the Guest confirms that they have been informed of the accommodation rules, reservation rules, and applicable rates.

1.3 Once the Hotel confirms the Guest’s request, the Parties shall be deemed to have concluded this agreement.


2. RESERVATION PROCEDURE

2.1 The Service may be reserved by calling 444 83 82 or by completing and submitting the reservation form on www.elbis.com.tr.

2.2 If the Guest wishes to cancel or make any changes to the reservation, the Guest may contact the Hotel by phone at 444 83 82 or by email at rezervasyon@elbis.com.tr, provided that the relevant terms of this agreement are fulfilled.

2.3 Requests to modify a reservation must be submitted by the Guest or the Guest’s authorized representative no later than 15 (fifteen) days before the start date of the stay, using one of the methods specified in Article 2.2.

2.4 The Guest may request up to two changes or cancellations without charge. If additional changes are requested, the Guest shall be required to pay any applicable fees in accordance with the Hotel’s amendment, reservation, and cancellation policy.

2.5 The Guest acknowledges and undertakes that if a reservation made during a special discount period (such as an early booking period) is changed for any reason, the new reservation will be priced according to the rates valid on the date the change is made. The Guest also acknowledges that special discounts will not remain valid for reservation changes made outside such promotional periods.

2.6 The Hotel will respond to any change request submitted within the applicable time limit, subject to availability.

2.7 Age-based discounts for children apply only when children stay in the same room as their parents (two adults). The age of the child(ren) declared at the time of booking shall be taken into account during registration upon arrival at the Hotel. The Hotel may request identification documents for the child(ren) at check-in. If there is any discrepancy between the age declared at the time of booking and the age shown on the identification documents, the necessary adjustments will be made to the reservation, and the Guest agrees to pay any resulting price difference.

2.8 At least one guest in each hotel room must be over the age of 18. Guests under the age of 18 may stay only if accompanied by at least one adult.


3. PAYMENT TERMS

3.1 Guests staying at the Hotel shall enter their own credit card details into the online reservation system when paying by credit card. Alternatively, payments may be completed through customer representatives, who may process the booking on behalf of the Guest using the requested dates, room details, and related information.

3.2 The Hotel confirms that credit card details and the systems through which such information is submitted are protected by special security systems intended to prevent the information from being viewed or copied in any way. However, the Hotel shall not be liable for any damage arising from malicious software, system vulnerabilities originating from the Guest’s device, or the Guest’s negligence, resulting in the disclosure of confidential data to third parties.

3.3 At check-in, the Guest shall present to Hotel staff either the credit card used during the online reservation process or a photocopy of the front side of that card. Any loss or damage arising from the Guest’s failure to fulfill this obligation shall be the sole responsibility of the Guest.

3.4 The invoice shall be issued to the Guest at check-out. If the Guest does not collect the invoice at check-out, it shall be sent to the address provided by the Guest. If no invoice address is specified, it shall be sent to the contact address. The Hotel shall not be responsible if the invoice is not received due to an incorrect address, failure to specify the recipient, or the recipient not being present at the stated address.

3.5 Payments made through our website shall be in Turkish Lira. Other payment methods (such as bank transfer) may be made in Euro, US Dollar, or British Pound Sterling. Exchange rate information is based on data provided by the Central Bank of the Republic of Türkiye.


4. CANCELLATION AND REFUND TERMS

4.1 If the Guest submits a cancellation request to the Hotel at least 1 (one) day before the check-in date using one of the methods specified in Article 2.2, the payment made by the Guest shall be refunded by the Hotel within 15 (fifteen) business days following the request, after deduction of applicable commissions, taxes, and similar expenses.

4.2 Refunds or reversals for payments made by credit card during the reservation process shall be returned by the Hotel to the bank account associated with the credit card used for payment and/or to the bank account from which the payment was sent.

4.3 In all refund transactions, commissions, taxes, and similar expenses shall be deducted by the Hotel before the refund is made to the Guest.


5. ACCOMMODATION TERMS

5.1 At check-in, the age and identity of the Guest and accompanying persons will be verified. The Guest accepts and undertakes all legal liability arising from providing incorrect information and agrees to bear any resulting costs.

5.2 The Guest shall pay for any extra expenses incurred during the stay at check-out.

5.3 Regardless of the arrival time, the Guest acknowledges that check-in is available no earlier than 15:00 on the day of arrival and that check-out must be completed no later than 11:00 on the day of departure. Any additional services provided after check-out shall be charged separately.

5.4 The full reservation amount shall be collected during the online reservation process.

5.5 Pets are not accepted by the Hotel.

5.6 If the Guest chooses not to continue using the service after checking into the Hotel, for any reason other than the Hotel’s failure to fulfill its obligations, no refund shall be made.


6. RESPONSIBILITIES OF THE PARTIES

6.1 If, after the Guest has been placed in the reserved room, any issue arises for reasons other than force majeure, the Hotel shall seek to compensate for the situation by offering additional and/or alternative services. Acceptance by the Guest of such additional or alternative services shall be deemed a waiver of the Guest’s right to request a refund of the reservation fee as compensation, as well as any other claim for damages or legal action.

6.2 If the Hotel fails to fulfill its obligations under this agreement, in whole or in part, the relevant laws and regulations shall apply in determining any compensation payable.

6.3 If the Guest considers the service provided to be inadequate, the Guest shall submit the complaint in writing to a Hotel representative; otherwise, the service shall be deemed to have been provided properly and on time.

6.4 If the Guest breaches any provision of this agreement, the Guest accepts and undertakes to compensate the Hotel for any and all losses arising from such breach.

6.5 The Hotel may modify the terms and conditions of accommodation services depending on seasonal conditions and the tourism season.


7. OTHER PROVISIONS

7.1 Adverse weather conditions, strikes or lockouts, terrorism, military operations, floods, fires, and other unforeseeable events shall be considered force majeure. In such circumstances, the Hotel may suspend the provision of services.

7.2 The Hotel reserves the right to modify programs organized for holidays, New Year, and other special occasions for reasons beyond the Hotel’s control.

7.3 Any disputes arising under this agreement shall be resolved before the competent courts and enforcement offices in accordance with applicable law.

7.4 The Hotel reserves the right to seek compensation for any material or non-material damage, destruction, and/or missing items caused by the Guest in the room or common areas.

7.5 The Guest shall not send any goods, items, or promotional materials subject to customs duties in the name of Hotel employees. The Hotel shall under no circumstances be responsible for customs procedures.

7.6 Smoking is prohibited in the Hotel’s indoor areas in accordance with applicable law. Accordingly, the use of cigarettes or tobacco products is not permitted anywhere within the Hotel except in designated guest rooms, where applicable.

7.7 This agreement shall enter into force once the Guest completes the reservation and payment and receives a reservation number from the Hotel, and shall terminate upon the Guest’s departure from the Hotel.
